A Harare lawyer Simbarashe Chigumira has been arrested for fraud.
Chigumira from Messrs Whatman is expected in court today at the Harare Magistrates’s Court.
The complainant is Believe Taguta, a Managing Director of Balwearie Holdings Private Limited based in Kadoma.
The case is being handled under IR 04045 at Harare Central.
It is alleged that on March 19, Chigumira, filed an application against Taguta under case number HCH 1285/25 at the High Court of Zimbabwe.
In his application, the accused attached a fraudulent judgment, purportedly judgment HH 559/23, portraying it as if it was issued in case HC 3847/22.
Allegations are that upon verification, the Chief Registrar of Superior Courts in Zimbabwe responded in writing (letter dated 3 April 2025), confirming that the actual parties to HC 3847/22 are Taleba Chisvinu vs. Anderson Chiorngom, a not Taguta.
The genuine judgment HH 559/23 relates to an entirely different case, Alois Gurajena vs. Ngonidzashe Chiyangwa, presided over by Tsanga J.
“The official letter from the Chief Registrar confirming this information is attached as Exhibit 3, and the actual judgment HH 559/23 provided by the Chief Registrar is attached as Exhibit 4.
“The accused person deliberately submitted fraudulent documents to the court, fully aware that they misrepresented the truth, in an attempt to mislead judicial proceedings.
“The accused has acted unlawfully in that he contravened Section 136 of the Criminal Law (Codification and Reform) Act Chapter 9:23 (Fraud) by engaging in deliberate deception for unlawful gain or advantage.
“The actions of the accused person were unlawful in that he misrepresented facts to the High Court, which could have resulted in prejudicial judicial outcomes.”
