Many people have been asking why the jailed Zim dancehall musician, Joseph “Chihomuhomu\/Chigudo Gudo” Mutamba, remains in custody despite the recent Presidential Amnesty that led to the release of over 4,000 inmates.<\/p>\n

Chigudo Gudo was sentenced to 14 years in prison for raping a 14-year-old girl in 2020.<\/p>\n

\"\"<\/p>\n

He was initially sentenced to 18 years, with 4 years suspended on the condition that he did not commit a similar offence within five years.<\/p>\n

\"\"<\/p>\n

Therefore, the effective sentence he is serving is 14 years.<\/p>\n

\"\"<\/p>\n

Reports indicated that he has continued to demonstrate reform and remains a prominent performer.<\/p>\n

Many had high expectations following the announcement of the amnesty.<\/p>\n

However, there are specific reasons why he did not qualify for release under this amnesty.<\/p>\n

The stipulated exclusions for the amnesty include serious offences such as murder, treason, carjacking, robbery, armed robbery, rape, and any sexual offenses, along with violations of various acts, including the Electricity Act, Co-operative Act, Railways Act, and Postal and Telecommunications Act.<\/p>\n

Other exclusions encompass public violence, trafficking in persons, and any conspiratorial activities related to these offenses.<\/p>\n

Given that Chigudo Gudo committed rape, he is currently ineligible for release.<\/p>\n

The Zimbabwe Prisons and Correctional Service conducted a nationwide audit through an electronic inmate data capturing program to identify eligible beneficiaries.<\/p>\n

A total of 4,305 inmates will benefit from this order, including 223 females and 4,082 males; however, for the males, 3,755 will be immediately released, while 327 will be released progressively.<\/p>\n

During a press conference held on Monday, Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi noted that inmates serving more than 48 months for non-specified offences will receive a one-quarter remission of their remaining sentences.<\/p>\n

President Mnangagwa exercised his executive prerogative of mercy under Section 112, Sections 1A and D of the Constitution of Zimbabwe.<\/p>\n

Following General Notice 99 of 2026, also known as Clement’s Order No. 1 of 2026, gazetted on February 20, 2026, the President granted a general amnesty to specific categories of convicted inmates.<\/p>\n

This executive action signifies a profound commitment to restorative justice, national compassion, and the strategic decongestion of correctional facilities, ensuring they serve as centers of rehabilitation rather than mere places of punishment.<\/p>\n

The 2026 amnesty is aimed at benefitting the people of the country. It is targeted and merit-based, focusing on vulnerable groups and those who have shown significant progress in their rehabilitation.<\/p>\n

To benefit, most inmates must have served at least one-third of their sentence as of the date of the gazette.<\/p>\n

The specific categories for full remission of the remaining period of imprisonment include all convicted female inmates (excluding those convicted of specified offences), all inmates under the age of 18 at the time of the order, those serving effective sentences of 48 months or less (provided they are not convicted of specified offenses), inmates aged 60 years and above who have served at least one-third of their sentence, and inmates certified as terminally ill by a correctional or government medical officer.<\/p>\n

This also includes the visually impaired and those with physical challenges that cannot be appropriately managed within a correctional facility.<\/p>\n

Additionally, inmates currently serving terms at the open prison and those who have served a minimum of 20 years, including those whose death sentences were commuted, are eligible.<\/p>\n

\u201cTo safeguard the public and uphold the rule of law, certain inmates are strictly excluded from this amnesty,\u201d Ziyambi stated.<\/p>\n

\u201cThe nation should understand that the amnesty is not meant to diminish the gravity of the crimes committed, but rather to acknowledge the capacity for human reform.<\/p>\n

\u201cI urge all Zimbabweans, families, community leaders, and the private sector to welcome these individuals with grace for successful reintegration.<\/p>\n
